1. Introduction

Welcome to Jataye.com (“we”, “us”, “our”). These Terms and Conditions govern your access to and use of our digital services, platforms, learning content, consulting, AI solutions, software tools, APIs, and any other services offered through our website or authorized partners.

By accessing our website or using our services, you (“User”, “Customer”, “Client”, “Trainee”, “Affiliate”) agree to be bound by these Terms and all applicable laws and regulations. If you do not agree, you may not access or use the services.

This document is legally binding and is to be read in conjunction with our Privacy Policy, Delivery & Commitments Policy, and Refund Policy.


2. Definitions

  • Jataye.com: Our official website and business entity operating under the name “Jataye Solutions”.
  • User: Any individual or legal entity using our platform.
  • Services: Includes AI tools, online courses, training, consultations, platform subscriptions, SaaS solutions, APIs, etc.
  • Content: Any training material, documentation, code, data, prompts, or text generated via Jataye services.

3. Account Creation & Management

  • All users must be 18 years or older or have parental consent.
  • Users agree to provide accurate, complete, and updated registration details.
  • You are solely responsible for safeguarding your login credentials.
  • Misuse of accounts, impersonation, or unauthorized access attempts will result in termination.

4. License & Usage Rights

Upon subscribing or purchasing services:

  • You receive a non-transferable, non-exclusive license to use the platform/tools.

5. Intellectual Property (IP)

  • Clients owning custom models must sign an IP transfer clause post-delivery.
  • Unauthorized copying, reverse engineering, or code extraction is prohibited.

6. Third-party Services & Integrations

Our platform may rely on third-party services (e.g., Google APIs, GitHub, ChatGPT API).

  • We do not guarantee uptime or performance of these integrations.
  • Users must also comply with third-party T&Cs.
  • Jataye is not liable for data breaches, errors, or failures originating from third-party systems.

7. Payment Terms

  • All prices are inclusive/exclusive of taxes as applicable by law.
  • Payment gateways are encrypted and secure. We do not store card credentials.
  • Late payments (enterprise contracts) incur 2% monthly interest.
  • Subscriptions auto-renew unless canceled at least 24 hours before renewal.

8. Refunds & Cancellations

Refer to our Refund Policy page. Summary:

  • No refunds after AI/API usage begins.
  • Partial refunds on training within 3 days.
  • Project-based service cancellations may incur penalties depending on work stage.

9. User Responsibilities

  • Users shall not upload, share, or generate content that is illegal, harmful, or misleading.
  • You are responsible for securing your own data backups.
  • You agree not to misuse or over-consume API or service bandwidth.
  • Corporate clients must ensure internal compliance when using our services.

10. Platform Access & Uptime

  • We strive for 99.5% uptime except for scheduled maintenance.
  • Access may be temporarily suspended for updates or security concerns.
  • Emergency outages or force majeure events are exempt from SLAs.

11. Code of Conduct

Jataye users, clients, instructors, and freelancers must adhere to our values:

  • No discrimination, harassment, abuse, or misconduct.
  • Respect all community members.
  • No unauthorized access or scraping of content.

12. Confidentiality

  • All client data is confidential.
  • NDAs are offered for enterprise contracts.
  • We do not share data with third parties unless explicitly permitted or required by law.

13. Warranty Disclaimer

  • Services are provided “as is” without warranties of any kind.
  • We do not guarantee success metrics like sales, ranking, or job placement unless stated in writing.

14. Limitation of Liability

  • Jataye.com shall not be liable for indirect, incidental, or consequential damages.
  • Maximum liability for any claim shall be limited to the amount paid by the user for the respective service.

15. Termination Policy

We reserve the right to:

  • Suspend or delete accounts in case of breach.
  • Terminate access for unethical usage, fraud, or malicious activities.
  • Deny service to entities violating Indian, US, or international law.

16. Dispute Resolution

  • All disputes are governed by Indian law.
  • Jurisdiction: Bengaluru, Karnataka.
  • Mediation is encouraged before legal proceedings.

18. AI Fair Use & Ethics

  • You agree not to use our models for hate speech, fake news, violence, or discrimination.
  • Prompt engineering and model usage must follow ethical AI practices.
  • We reserve the right to disable access to tools violating AI norms.

19. Training Courses & Certifications

  • Course materials are for personal use unless enterprise license is purchased.
  • Completion does not guarantee employment unless explicitly stated.
  • Copying, redistributing, or screen-recording content is prohibited.

20. Affiliate & Referral Program

  • Affiliates must follow fair promotion policies.
  • Fraudulent leads, spam, or misuse will result in disqualification.
  • Referral bonuses are released after customer confirmation and no refunds.

21. Community & Forum Use

  • Posts must be respectful and non-commercial.
  • Spam, hate, or harassment will lead to a ban.
  • We reserve the right to delete or moderate content.

22. SaaS API Limits & Abuse Prevention

  • API requests are rate-limited to ensure fair use.
  • Abuse or overuse may result in throttling or blocking.
  • Premium plans offer higher thresholds with usage reports.

Jataye.com is not liable for failure to deliver due to:

  • Acts of God, war, strikes, internet failure, pandemics
